As a part of the WHS Act (2011) an employer MUST ensure that all psychological risks have been identified, managed and are monitored. Very significant fines can apply and yet, many business owners and managers are at risk.

Meaning of "Health"

The definition of "Health" under the law "means physical and psychological health". This means that every time health is mentioned, we MUST consider the psychological health of workers.

Duty of Care

Section 27 of the WHS Act outlines the Duty of Care that an employer has in relation to the health and safet of their workers

Management of Risks

Section 17 outlines the management of risks with enforcement agencies advocating for a similar approach to risk management for physical risk - see guidance.

Training

Section 19 outlines the need for a PCBU to ensure adequate, risk-based training is performed in a planned and recorded manner.

The fact of the matter is two-fold:

  1. employers are unaware of the exposure they are facing in this area

  2. and that the positive rewards of a good psychosocial safty climate far outweight percieved cost, regardless of legal requirements.
